Gannawarra Shire is a rural municipality of A 3,740km2, with B 6,846 assessments generating C over $7 million in rates and charges. D 12,000 Population 2.2 Definitions of rate classifications Council levies rates on all rateable properties, within the following differential rate classifications: Rate Classification Rate in $ Number of Assessments A General Rate (100%) 0.3688 4,324 B Commercial/Industrial Rate (114.8%) 0.4234 473 C Farm Rate (83%) 0.3061 1,316 D Dryland Rate (99.75%) 0.3679 505 E Cultural & Rec. Lands Charge 12 Each differential rate in the dollar is determined by multiplying the General Rate in the dollar by the relevant percentages for each classification. Council considers that a differential rate will provide equitable distribution of the rate burden across all levels of the community. The differential rate is declared for rateable land having the following characteristics: B Commercial/Industrial Rate: to apply to all properties used primarily for either commercial and or industrial purposes. C Farm Rate: to apply to all properties within declared irrigation districts and that satisfy the meaning of "farmland" as defined in the Valuation of Land Act 1960. D Dryland Rate: to apply to all property NOT within declared irrigation districts and that satisfy the meaning of "farmland" as defined in the Valuation of Land Act 1960. 2.3 Valuation Summary In accordance with Section 13DC of the VLA, all Victorian councils are required to conduct a General Valuation every two years. This contract requires a general valuation of all rateable and non-rateable property to be made, as at the prescribed date of 1 January 2008, by the due dates specified (see section 1.5) and to be returned by 31 March 2008. The advice can be summarised as follows: Having regard to the decision in the Shell Company* case, all rents should be ‘grossed up’ as the starting point for calculating the EAV and this includes municipal rates even though these may be paid by the tenant under an agreement. The Local Government Act 1989 clearly made owners liable for municipal rates and charges. The effect of the amendment (No 91 of 1994) to the Valuation of Land Act 1960 was clearly to remove the deduction of local government rates as an expense in the calculation of EAV. The following is an example of a typical rent situation where the tenant pays all outgoings in addition to the rent. A Municipal rates and charges $ 5,000 B Water rates $ 3,500 C Water usage charges $ 1,500 D Building insurance $ 5,000 E Repairs and maintenance $ 20,000 F Land tax $ 10,000 G Rental paid directly to owner $100,000 H Gross Rent $145,000 The calculations of EAV using the above outgoings is assessed on the basis that rates and taxes are an owner’s tax (except for water usage charges which are payable by the tenant if separately metered). Gross Rent $145,000 Water usage charge - $ 1,500 Starting point rent free from tenants rates and taxes = $143,500 (assuming land tax and municipal and water rates are all owners expenses) Less Water rates $ 3,500 Building insurance $ 5,000 Repairs and maintenance $ 20,000 Land tax $ 10,000 EAV = $105,000 Td TGA The Tender Box: The Tender Box TGB Council Reference No: TGC Tender Addressee: TGD Position: TGE Department: TGF Organisation: Vic - Gannawarra Shire Council TBA Room/Suite: Foyer TBB Floor: TBC Building: Civic Centre TBD Street Number: TBE Street: PO Box 287 TBF Suburb: KERANG TBG State: VIC TBH Post code: 3579 TBI Country: Australia TMW Map for Location: TFI Further Information: Tf BRA Briefing Session Date: BRB Briefing Session Time: BRC Compulsory Attendance Y/N: BDR Briefing Registration Date: BTR Briefing Registration Time: BRO Number of Attendees: BRE E-mail Address: BRF Briefing Contact Officer - Preferred: BRG Briefing Contact Officer - Family: BRH Business Title: BRI Department: BRJ Tel Area Code: {61}(3) BRK Tel Number: BRL Fax Area Code: {61}(3) BRM Fax Number: BRN Mobile: Tg BSA Room/Suite: BSB Floor: BSC Building: BSD Street Number: BSE Street: BSF Suburb: BSG State: BSH Post code: BSI Country: Australia BMW Map for Location: BFI Further Information: Tb AAB Organisation: Vic - Gannawarra Shire Council ABA Room/Suite: ABB Floor: ABC Building:Civic Centre ABD Street Number: 49 ABE Street: Victoria Street ABF Suburb: KERANG ABG State: VIC ABH Post code: 3579 ABI Country: Australia ABJ Inquiry E-mail Address: council@gannawarra.vic.gov.au ABW Council Web Address: www.gannawarra.vic.gov.au AMW Map for Location: AFI Further Information: Tc ADC Tel Area Code: {61}(3) ADD Telephone No: 5456 5222 ADE Free Phone: ADF Fax Area Code: {61}(3) ADG Fax Number: 5456 2173 ADH Free Fax: ADJ Lodgment E-mail Address: ADW Lodgment Web Address: Tender Lodgment Web Link AMW Map: GFI Further Information: Te ACA PO Box: PO Box 287 ACB Post Office: ACC Suburb: KERANG ACD State: Vic ACE Post code: 3579 ACF Country: Australia ACJ Council E-mail Address format: E-mail Link ACW Contacts Web Address: Contacts Web Link CFI Further Information: PG1 Th PDE E-mail Address: PDF Documentation Officer - Preferred: PDG Documentation Officer - Family: PDH Business Title: PDI Department: PDJ Tel Area Code: {61}(3) PDK Tel Number: PDL Fax Area Code: {61}(3) PDM Fax Number: PDN Mobile: PDW Web Address: Tender Attachments PEW Web Address: Standard Tender Documents PLW Legislation referred to in this tender may include: A LOCAL GOVERNMENT e State Concessions Act 2004 (Vic) d Road Management Act 2004 (Vic) c Domestic Animals Act 1994 (Vic) b Victoria State Local Government Act 1989 (Vic) a Municipalities Assistance Act 1973 (Vic) B ADMINISTRATION c Information Privacy Act 2000 (Vic) b Freedom Of Information Act 1982 (Vic) a Public Records Act 1973 (Vic) C CHILD PROTECTION LEGISLATION d Child Wellbeing and Safety Act 2005 (Vic) c Child Employment Act 2003 (Vic) b Children's Services Act 1996 (Vic) a Children's and Young Persons Act 1989 (Vic) D HEALTH h Health Services (Governance) Act 2000 (Vic) g Health Legislation (Further Amendment) Act 2003 (Vic) f Health Legislation (Amendment) Act 2003 (Vic) e Health Services (Amendment) Act 2001 (Vic) d Health Services (Amendment) Act 1998 (Vic) c Health Services (Amendment) Act 1997 (Vic) b Health Services Act 1988 (Vic) a Health Act 1958 (Vic) E ELECTRICITY d Electricity Industry (Wind Energy Development) Act 2004 (Vic) c Electricity Industry Act 2000 (Vic) b Electricity Safety Act 1998 (Vic) a Electricity Industry (Residual Provisions) Act 1993 (Vic) 1 The Energy and Water Ombudsman (Victoria) (EWOV) - supposed to provide online copy of "Energy Retail Code" F LAND a Valuer General Victoria Valuation Best Practice Guidelines EFI Further Information: Attachments No: 6 A) pdf 582 Kb: Specification B) pdf 969 Kb: Appendices A - L C) xls 138 Kb: Appendix N - Shire Fixed Asset Register D) pdf 177 Kb: Policy 033 - Occupational Health & Safety Policy - all employees and volunteers EXTRACT FROM 0H&S POLICY 033 1.
