1. POLICY

MUNICIPAL VALUATION SERVICES
Tenders are invited from suitably experienced and qualified Valuers for the provision of
Valuation Services in accordance with the State Government’s "Valuation Best Practice Standards
2008".
Gannawarra Shire is a rural municipality of

2.2 Definitions of rate classifications
Council levies rates on all rateable properties, within the following differential rate
classifications:

Each differential rate in the dollar is determined by multiplying the General Rate in the
dollar by the relevant percentages for each classification.
Council considers that a differential rate will provide equitable distribution of the rate
burden across all levels of the community.
The differential rate is declared for rateable land having the following characteristics:
B Commercial/Industrial Rate:
to apply to all properties used primarily for either commercial and or industrial
purposes.
C Farm Rate:
to apply to all properties within declared irrigation districts and that satisfy the
meaning of "farmland" as defined in the Valuation of Land Act 1960.
D Dryland Rate:
to apply to all property NOT within declared irrigation districts and that satisfy the
meaning of "farmland" as defined in the Valuation of Land Act 1960.
2.3 Valuation Summary
In accordance with Section 13DC of the VLA, all Victorian councils are required to conduct a
General Valuation every two years.
This contract requires a general valuation of all rateable and non-rateable property to be
made, as at the prescribed date of 1 January 2008, by the due dates specified (see section 1.5)
and to be returned by 31 March 2008.
A summary of council’s rate assessments (including exempt properties) as at 1 July 2006 is
provided on the following schedule.

In providing a lump sum price, tenderers should make an allowance for variations to the total

CALCULATION OF ESTIMATED ANNUAL VALUE (EAV)
In 1995 VGV sought legal advice from the Victorian Government Solicitor regarding the correct
method of calculating Estimated Annual Value (EAV).
The advice can be summarised as follows:
Having regard to the decision in the Shell Company* case, all rents should be ‘grossed up’ as
the starting point for calculating the EAV and this includes municipal rates even though these
may be paid by the tenant under an agreement.
The Local Government Act 1989 clearly made owners liable for municipal rates and charges.
The effect of the amendment (No 91 of 1994) to the Valuation of Land Act 1960 was clearly to
remove the deduction of local government rates as an expense in the calculation of EAV.
The following is an example of a typical rent situation where the tenant pays all outgoings in
addition to the rent.

The calculations of EAV using the above outgoings is assessed on the basis that rates and
taxes are an owner’s tax (except for water usage charges which are payable by the tenant if
separately metered).
