4 Solution Independent Needs 28 4.1 User Classes/Roles 28 4.2 Local Council transactions available via EasyBiz - - THIS WEB PAGE 28 4.2 Local Council transactions available via EasyBiz This section describes each of the Local Government transactions that EasyBiz will be required to support. This section provides brief "real life" examples of when a small/home based business is required to lodge a permit application for each type of transaction. The Local Government transactions that will be available to small/home based businesses by April 2007 are listed in the table below. TABLE 8 - LOCAL GOVERNMENT TRANSACTIONS AVAILABLE IN EASYBIZ TRANSACTION DEFINITION EB001 Application to build over easements This permit is required if a small/home based business intends to build over an existing easement. e.g. sewerage and water connected to property. The permit must be applied for any new construction or enhancements to an existing building. This is a Building Services. TRANSACTION DEFINITION EB002 Builders Refuse Bins This permit is required by any small/home based business that intends to place a bin skip/bulk rubbish container onto a public road or public access area. In most instances this will relate to construction sites or large public events. The bulk rubbish bin may be placed on the road, on the nature strip. This is a Local Law permit. TRANSACTION DEFINITION EB003 Building Inspections (EB003) This is no longer required TRANSACTION DEFINITION EB004 Extend a building permit (EB004) This permit is required by any small/home based business that has applied for and been granted a building permit and now wishes to undertake either of the following: 1 Variation to the building permit which has been issued by council due to variations/modifications to works as per building permit 2 Extend the two year time period that the building permit is valid for. This permit can only be applied for if the small/home based business has an approved and valid building permit. This is a Building Services permit. TRANSACTION DEFINITION EB005 Hoarding/Scaffolding permits (EB005) This permit is required by any small/home based business that intends to conduct construction works, where activity associated with those construction works may impede upon public access areas. The permit covers the erecting of hoarding around the construction site, the temporary closure of roads, the erection of scaffolding, the storage of construction materials and equipment. This is a Building Services permit. TRANSACTION DEFINITION EB006 Out of hours building permits (EB006) This permit is required by any small/home based business that has applied for and been granted a building permit and wishes to apply for permission to undertake building works outside nominated hours. Although EPA guidelines dictate hours of building works permitted for residential properties, these hours are often mimicked for commercial buildings as they are generally in the vicinity of residential properties. This is a Building Services permit. TRANSACTION DEFINITION EB007 Section 32 transactions (covers land This is not a permit but a request for information from information, property information, council. planning and health certificates) (EB007) The Section 32 Vendors Statement must be prepared by or on behalf of the vendor (selling a property), and served on any person who wishes to purchase the vendor's property before the sale contract is signed. A large portion of the information that comprises a Section 32 is to be obtained from the council in which the property is located. The small/home based business (usually a conveyancing lawyer/solicitor) will be required to obtain, on the vendor's behalf the following: 1 land information (rates) certificate 2 request for property information in reference to building regulation 326 (sale of land information) 3 planning 4 health The EasyBiz form will be a request for information submitted by the small/home based business to the council asking for the above information. This is a "whole of council" information request. TRANSACTION DEFINITION EB008 Animal Registration (EB008) This permit is required by any small/home based business that intends to keep a certain number of animals at a premises. This involves registering an animal. This is not a permit to request keeping more animals than usually permitted nor is it a permit to operate a business involving animals. The permit must be completed by the owner of the animals. This is a Local Law permit. TRANSACTION DEFINITION EB009 Animal Registration Renewal (EB009) This is no longer required TRANSACTION DEFINITION EB010 Application to submit plans for a This permit is required by a small/home based food act premises (EB010) business that wishes to submit plans to operate a food business (preparation, manufacture, consumption, sale of food) who wish to change the design/layout of the premises. This is a Food/Health permit. TRANSACTION DEFINITION EB011 Rate rebate form (EB011) This is not a permit. A rate rebate form is a request from a small/home based business to apply for a concession in regards to the council rates they are charged. Specifically, this rebate covers sustainable land management and provides eligible landowners with a monetary incentive in the form of a rate rebate to undertake and/or maintain land management works that will improve the quality of land and water resources, maintain or enhance local biodiversity, and address land degradation issues. This is a Rates and Revenue transaction. TRANSACTION DEFINITION EB012 Application for temporary registration This permit is required by a small/home based of food act premises (EB012) business that wishes to sell food for a temporary period of time (usually less than 12 events per year - any more and they would need to fully register under the Food Act). This includes festivals, fetes, food stalls, and one-off events. This is a Food/Health permit. TRANSACTION DEFINITION EB013 Application for transfer of food Act This permit is required if a small/home based premises (EB013) business is purchasing an existing food business. The purpose of the permit is to transfer the Food Act Registration into the name of the new owner. The small/home based business purchasing the existing food business must apply for the council registration of the business to be transferred into the new owner's name. This is a Food/Health permit. TRANSACTION DEFINITION EB014 Application for registration of A permit is required to register a premises under the Food/health Act premises (EB014) Food Act and to register a premises under the Health Act. This does not cover the renewal process as renewal notices are generated by councils and sent to applicants on a periodic basis. This is a Food/Health permit. TRANSACTION DEFINITION EB015 Application to submit plans for This permit is required by any small/home based health act premises (EB015) business wishes to submit plans to operate a business that provides beauty/health related services or services that need to continuously manage public health issues e.g. accommodation providers, caravan parks. This is a Food/Health permit. TRANSACTION DEFINITION EB016 TRANSACTION DEFINITION EB017 Planning permit for selling liquor This permit is required by a small/home based business if they intend to use land to sell or consume liquor. The planning permit must be completed for new premises, existing premises which are changing their hours of operation or use. A planning permit is not required if the small/home based business intends to sell only packaged liquor for consumption e.g. bottle shop or only manufacture liquor. Other related non-council transactions include lodging a permit application with the Consumer Affairs Victoria. This is a type of planning permit. TRANSACTION DEFINITION EB018 Application to Install/alter a This permit is required if a small/home based septic tank system (EB018) business intends to either install a new septic tank or alter an existing septic tank. The permit is required by the owner of the septic tank. This is a type of Building Services permit. TRANSACTION DEFINITION EB019 Domestic Animal Businesses (EB019) This transaction is for the registration of a Domestic Animal Business. This type of business may include an animal shelter, council pound, pet shop, or a for profit enterprise that breeds, rears, trains or boards cats and dogs. Registration is intended to promote the maintenance and standards of these businesses. The owner of the business must lodge the application. This is a Local Law. TRANSACTION DEFINITION EB020 Display of Goods on Footpath permit This permit is required for the placement of the (includes A-frame advert and kerbside following (example) items by a proprietor of a cafe) (EB020) business on the footpath outside the proprietor's business premises: 1 Placement of goods; 2 Advertising materials; 3 Outdoor dining including tables and chairs, and any allowable ancillary items (e.g. umbrellas, screens, planters, heaters); The permit is required by the owner of the business. It is a Local Laws permit. TRANSACTION DEFINITION EB021 Application for a Planning permit This permit is required where a small/home based (extension to a property used for business wishes to extend an existing business business) (EB021) premise (not construct a new premise) for the purpose of continuing to provide the same products and services e.g. the extension will not result in a change of use/purpose of the business. Extension refers to the increase in leasable area, e.g. the addition of a room, mezzanine etc. If the extension to the building does result in a change of use to the overall business (as recorded in the planning permit already approved for the business), the small/home based business will need to submit a change of use planning permit application. A planning permit is required before a building permit can be issued. TRANSACTION DEFINITION EB022 Application for a Planning permit This is no longer required (reduction /waiver of car parking requirements) (EB022) TRANSACTION DEFINITION EB023 Building Permit (extension to an This permit is required where a small/home based existing property used for business) business wishes to extend a property that is currently (EB023) used for business. Extension refers to the increase in leasable area, e.g. the addition of a room, mezzanine etc. The permit doesn't cover alterations to an existing structure/building/property e.g. removal of or alteration to a load bearing-part of a building, (although a building permit is still required). There are many other building permit options covered in the building permit application form but these are not covered here. TRANSACTION DEFINITION EB024 Permit for advertising / signage This permit is required by a small/home based (EB024) business that intends to erect/construct advertising/signage on the outside of their business premises, not on council land. The permit is required by the owner of the business. It is a type of planning permit. TRANSACTION DEFINITION EB025 Permit for works in road reserve There are two permits covered in this transaction: (covers Road Opening Permits and Road opening permit: Vehicle Crossings/Asset Protection (Builder's Crossing) Permit) (EB025) 1 Required where a road is opened up to connect a service related to one property. This transaction is covered under Road Management Act. It is a Building Services permit. 2 Asset protection: This permit is required for any building/ construction or demolition work carried out by a business which could harm council assets e.g. road kerbs, footpaths, nature strips. A permit must be obtained prior to commencing works and will usually involve some form of "bond" being paid by the business. It is a Local Law permit.
